POCSO Act: Protecting Every Child’s Right to Safety

By Parminder Kaur, Profession: Teacher

Children are the future of every nation, and ensuring their safety, dignity, and well-being is one of society’s greatest responsibilities. To protect children from sexual abuse and exploitation, the Government of India enacted the Protection of Children from Sexual Offences (POCSO) Act, 2012. The Act provides a comprehensive legal framework to protect children below the age of 18 from sexual offences, irrespective of gender.

Understanding the POCSO Act

The POCSO Act, 2012 addresses different forms of sexual offences against children, including sexual assault, sexual harassment, and the use of children for pornographic purposes.

The law also recognizes aggravated forms of offences when they are committed under circumstances involving positions of trust, authority, or responsibility. Depending on the nature and severity of the offence, the Act provides for stringent punishments.

The purpose of the legislation is not only to punish offenders but also to establish mechanisms that prioritize the protection and dignity of children throughout the legal process.

A Child-Friendly Legal Approach

One of the important features of the POCSO framework is its emphasis on a child-friendly approach.

The law provides safeguards intended to reduce additional trauma for children during investigation and trial. These include measures relating to the recording of a child’s statement, protection of the child’s identity, and proceedings before Special Courts designated to deal with such cases.

Maintaining the confidentiality and dignity of a child is particularly important because children may find it difficult to speak about abuse or cooperate with legal proceedings.

Mandatory Reporting

The POCSO Act places importance on reporting suspected child sexual offences to the appropriate authorities. Time
