The Supreme Court on Monday issued an important direction on a petition seeking action against the manufacturing and sale of counterfeit and adulterated medicines. The court directed its Registry to send a copy of the petition to the concerned authorities so that they can examine the issues raised in it. The petition seeks a comprehensive system and an effective framework to tackle the problem of fake medicines.
A bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohana was hearing the matter. During the hearing, the bench asked petitioner Ashwini Kumar Upadhyay whether he had approached the concerned authorities with his demands or suggestions before filing the petition.
The petitioner highlighted several alleged shortcomings in the existing system. He also referred to reports regarding the alleged supply of counterfeit anti-cancer medicines to several hospitals in Bengaluru.
The bench observed that instead of keeping the petition pending, it would be more effective to forward it to the concerned authorities as a representation. The court subsequently directed the Registry to send a copy of the petition to the relevant authorities.
The petition seeks the formulation of a comprehensive policy to prevent the manufacturing, distribution, and sale of counterfeit and adulterated medicines. It also emphasizes the need for stronger monitoring of the pharmaceutical supply chain and effective measures to control the sale of fake medicines.
The Supreme Court also noted that the petitioner had not approached the concerned authorities before moving the court. Following the court’s direction, the relevant authorities will now consider the issues and suggestions raised in the petition.
