The GST Council is scheduled to meet on October 7 to consider several important proposals related to tax administration. These may include limiting the arrest powers of GST officers and increasing the threshold for prosecution in certain cases.
Under the proposed changes, GST officers may no longer have the power to make arrests directly. If an arrest is considered necessary in a case, a court order may be required. This could increase judicial oversight over the arrest process in GST-related matters.
Another proposal seeks to increase the existing prosecution threshold from ₹1 crore to ₹5 crore. The objective is reportedly to restrict criminal proceedings to larger and more serious tax-related cases.
At present, GST officers can make arrests in serious cases after obtaining prior approval from an officer at the commissioner level. These cases include tax evasion involving more than ₹1 crore, fraudulent availment of input tax credit (ITC), or obtaining refunds through fraudulent means.
The GST Council may also consider an important proposal concerning GST paid on insurance premiums provided by employers for their employees. Under the proposal, employers could be allowed to claim input tax credit (ITC) on GST paid on such employee insurance premiums.
If approved, these proposals could bring significant changes to tax enforcement and prosecution procedures under the GST framework. However, the final decision will be taken at the GST Council meeting.
